According to reports from several market research organizations such as IMS Research and Strategies Unlimited, since 2007, emerging LED manufacturers such as Samsung LED and Seoul Semiconductor have consistently ranked the top five in the world in terms of their total revenue from LED packaging products. The market position of traditional LED suppliers such as Osram and Philips has caused a strong impact.
In response to the above situation, Nichia and others first waved the patent lawsuit as a powerful weapon to attack Seoul Semiconductor, etc., while the latter did not bother to show weakness and carried out active resistance, which also made the competition of new and old forces in the field of LED lighting gradually entered. Although most of these patent litigation battles ended in the settlement of the two parties and signed the cross-licensing agreement, the author believes that for the domestic LED lighting industry as an update practitioner, there is absolutely no such thing as a resounding result. In order to enable the domestic industry to have a clearer understanding of patent litigation in the field of LED lighting, and to better prevent patent litigation that may be encountered in the future, the author in this article is March 2011 Philips Electronics and its subsidiaries Philips Lumileds Lighting Company LLC (hereinafter collectively referred to as Philips) accused Seoul Semiconductor of infringing the LED patent case as an example.
In this case, Philips proposed that the products of Seoul Semi conductor infringed its US5, 779, 924, US6, 274, 924, US6,547,249, US6,590,235 and US6,717,353 patents, see Table 1. These five patents related to LED chip surface roughening or interface microstructure, SMD bracket and package structure, LED chip array integration, high stability optical LED package structure and LED chip and phosphor combined for optical wavelength conversion Key technical topics. Obviously this is a strong patent portfolio that covers a number of important technology nodes in the field of LED chips and packaging, with virtually no circumvention. This shows that Philips has made comprehensive and adequate preparations before filing an infringement lawsuit. At the same time, as far as the filing date of the five patents involved, it was mainly from 1996 to 2002, which shows that Philips has already carried out extensive patent distribution on these technical nodes. In other words, in fact, if we extend the patent infringement lawsuit filed by Nichia, we can easily draw similar conclusions.
